1. Who we are and these terms

BabyPlanned (the “service”) is provided by BabyPlanned, Spain, contact support@babyplanned.com. By creating a plan or using the app, you agree to these terms. Please also read our privacy policy.

You must be at least 18 years old, or the age of majority where you live, to create a plan or subscribe.

2. What BabyPlanned is

BabyPlanned is an organisational tool. It turns your answers into a plan of items and tasks for the weeks before birth and your baby’s first year, lets you share it with people who help, and lets you share a gift list with family and friends. It is available as an app for iPhone and Android; this website offers information and public pages for gift lists and invitations.

3. Not medical advice

BabyPlanned does not provide medical, safety or professional advice. It does not diagnose, prescribe, certify products or check recalls. Quantities and timings are general starting points. Always follow your doctor, midwife, health visitor or other health professionals, your hospital or maternity unit, product manufacturer instructions, and the laws and guidance where you live. In an emergency, call your local emergency number.

4. Your account and household

  • You sign in with your email address. Keep access to that email secure: anyone who can read it can sign in.
  • The person who creates a household is its owner and can invite partners or caregivers. Invited members can view and, depending on their permissions, edit the shared plan. Only invite people you trust.
  • You are responsible for the information you enter, including any information about other people, and for having the right to share it.

5. Subscriptions and payments

  • A free preview is available. The full plan requires a BabyPlanned subscription, offered as an annual or monthly plan. Prices are shown in the app before you buy and may include taxes as required locally.
  • Purchases are made through the Apple App Store or Google Play and charged to your Apple ID or Google account at confirmation. Their terms and payment rules also apply.
  • Subscriptions renew automatically for the same period unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
  • Free trials, if offered, convert to a paid subscription at the end of the trial unless cancelled at least 24 hours before it ends. Any unused part of a trial ends when you buy a subscription.
  • Cancel anytime in your device settings: on iPhone, Settings → your name → Subscriptions; on Android, Google Play → Payments & subscriptions → Subscriptions. Cancelling stops future renewals; you keep access until the end of the paid period. Deleting the app or your plan does not cancel the subscription.
  • Refunds are handled by Apple or Google under their policies and applicable law (Apple: reportaproblem.apple.com; Google Play: request a refund in your Play account). We cannot issue refunds for store purchases directly, but we are happy to help: support@babyplanned.com.
  • Price changes apply from your next renewal. Apple or Google will notify you in advance and, where required, ask for your consent; if you don’t agree, you can cancel before the change applies.
  • Use Restore purchase in the app to unlock a subscription on a new device signed in to the same store account.

Right of withdrawal (EU/UK consumers): you may have a legal right to withdraw from a purchase within 14 days. Because purchases are made through Apple or Google, withdrawal requests are handled by them under their procedures. Where you asked for immediate access to digital content, the right of withdrawal may end once access begins, to the extent the law allows.

6. Gift lists

You can share selected items through a private, expiring link. Guests verify their email before reserving. BabyPlanned does not sell, deliver or guarantee any products. Guests buy gifts themselves from the retailer of their choice and are responsible for that purchase; any issue with a product is between the buyer and the seller. Reservations are a courtesy to avoid duplicates and do not create any obligation to buy.

7. Acceptable use

Please don’t misuse the service. In particular, don’t:

  • break the law or infringe anyone’s rights, or use the service to harass or harm others;
  • add other people’s data without a right to do so, or send invitations or gift links as spam;
  • attempt to access other households, bypass security or payments, overload, scrape or reverse engineer the service, except where the law allows;
  • upload malware or content that is unlawful, abusive or misleading.

8. Our content and your content

The app, website, catalog, rules, texts, icons and brand belong to us or our licensors and are protected by intellectual property law. We give you a personal, non-exclusive, non-transferable licence to use the app for your own household while these terms apply.

Your answers, notes and decisions remain yours. You give us permission to store and process them only to provide the service to you and the people you share with.

9. Changes to the service

We keep improving BabyPlanned and may change or remove features. If a change significantly reduces what you paid for, we will tell you in advance and you can cancel; where the law requires, you can receive a proportionate refund for the remaining period.

10. Liability

We provide the service with reasonable skill and care. If you are a consumer, you have legal rights in relation to digital services that are not as described or not fit for purpose, and nothing in these terms affects them.

We are not liable for losses that were not foreseeable, for decisions you make without following the professional guidance described in section 3, for products bought from third parties, or for business losses. To the extent the law allows, our total liability to you is limited to the amount you paid for the service in the 12 months before the claim.

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, for gross negligence or wilful misconduct, or any other liability that cannot be limited under applicable law.

11. Ending your use

You can stop using BabyPlanned at any time and delete your plan in the app (see delete account); remember to cancel your subscription in your store settings. We may suspend or close access if you seriously or repeatedly breach these terms, or if required by law. Where reasonable, we will warn you first and give you a chance to export your data.

12. App store terms

If you downloaded the app from the Apple App Store, these terms are between you and us, not Apple. Apple is not responsible for the app, its content, maintenance or support, or for any product claims, including claims that the app infringes third-party rights; we are. If the app fails to meet any applicable warranty, you may notify Apple, which may refund the purchase price; Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them. Your use must also comply with Apple’s Usage Rules. Similar principles apply to Google Play under Google’s terms.

You confirm that you are not located in a country subject to a US government embargo and are not on any US government list of prohibited or restricted parties.

13. Governing law and disputes

These terms are governed by Spanish law. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring proceedings in the courts of your country of residence or in Spain. Please contact us first; most issues can be solved quickly by email.

14. Changes to these terms

We may update these terms to reflect changes to the service or the law. We will give you reasonable notice of significant changes in the app or by email. If you don’t agree, you can stop using the service and cancel your subscription before they apply.
